1. All blown optical fiber material manufactured or supplied by
NextGen/General Cable is warranted to be free from defects in materials
and workmanship for a period of fifteen (15) years.
2. All fibers manufactured or supplied by NextGen/General Cable will meet
the applicable requirements set forth by EIA/TIA 568A on the date of shipment
for a period of fifteen (15) years.
3. NextGen/General Cable’s sole obligations and liabilities under
this warranty are limited to the replacement or repair of or the issuance
of credit with respect to any materials which are proved to be other than
warranted. NextGen/General Cable will retain sole discretion as to which
remedy will be provided.
Under no circumstances or conditions will NextGen / General Cable be liable
or responsible for any claim for costs, expenses, or any special consequential
or incidental damages beyond the price of the material purchased. No charge
for labor or other expense required will be allowed.
4. Any claims made under this warranty will be deemed to be waived unless
written notice of such claim is given within ninety (90) days after the
date the claimed defect is discovered. NextGen / General Cable reserves
the right to inspect the material claimed to be defective and to determine
whether the claimed defect is covered by the warranty.
5. NextGen / General Cable’s warranty will not apply to any materials
which have been subjected to any misuse, abuse, neglect, or accidental
damage or to any cable or parts thereof which contain defects which are
in any way attributable to improper installation or to alterations or
repairs made or performed by any person or entity not under control of
NextGen / General Cable. Additionally, the warranty will not apply to
any material not installed or used in a workmanlike manner following standard
installation practices or to any cable not installed by a certified installer.
6. THIS WARRANTY IS THE EXCLUSIVE WARRANTY WITH RESPECT TO THE PRODUCTS
COVERED. ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY EXCLUDED.
